Royalty-Free is defined as purchasing an item
for a one-time fee without having to pay any further
commissions for it's useage. Royalty-free does
NOT mean 'free to sell, free to give away, etc.)
Acceptable Useage of our products is limited to:
- Creating a website for yourself
- Creating a website for your clients from which
you receive payment
- Modification of individual graphics contained
within a web page template
- You are permitted to modify graphics in any
manner you require - such as resizing, applying
text, changing color, etc.
- Make back-up copies of templates and graphics
on another computer, CD, or related format.
- If you are unsure as to whether or not your
intended use will violate our policies, please
contact us.
Unacceptable Useage of our products includes:
- Making copies of the templates and graphics
either individually or as part of a collection,
for the purposes of distribution through any internet
website, CD or related format.
- Resale of templates and graphics is forbidden.
You are not permitted to resell our templates
other than in the creation of a website for your
clients.
- Decompilation of templates for the purpose of
extracting individual graphics for useage in other
products, distribution, resale, etc.
- Using our templates in the creation of a website,
newsletter or other electronic publication which
promotes or engages in SPAM.
- Hosting templates on your server where they
may be accessed by web users. You must host the
files on your computer, or CD back up.
- If are unsure as to whether or not your intended
use will violate our policies, please contact
us.
DotComTemplate.com takes all appropriate actions
to
discontinue violations of this agreement, which
may include:
- Contacting the web hosting company where the
content is being sold and distributed from. This
often results in website owners losing their hosting
account and being responsible for any fines associated
with that account.
- Contacting any and all payment processing services
used to accept payment for the content being sold
and/or distributed. This may result in those particular
accounts being closed.
- If the content is being sold at auction, we
will report the activity to the auction administrators.
This will result in auctions being discontinued,
and in some cases a loss of account.
- Contacting your ISP to report the fraudulent
activity which could result in loss of your account.
- We may decide to take legal action to cease
the activity, acquire financial compensation,
and take all other actions we feel are appropriate.
- If you purchased our products as part of a collection
or individually from another source other than
DotComTemplate.com, and in turn you distribute
and/or resell those products, you are subject
to the same consequences. Author references and
copyrights are easily removed from these types
of products (especially in the case of web page
templates) which you may not even be aware of.
It is your responsibility to ensure that you are
not distributing and reselling items which are
not infringing on other's rights.
*No refunds will be given for any purchases from
NewTemplates.
*DotComTemplate products are provided "as
is" without warranty of any kind, either
expressed or implied.
DotComTemplate will not be liable for any damage
or loss of data whatsoever due to downloading
or using a template. In no event shall DotComTemplate
be liable for any damages including, but not limited
to, direct, indirect, special, incidental or consequential
damages or other losses arising out of the use
of or inability to use the templates and/or information
from DotComTemplate.
